The NY Times reported that one factor that delayed the indictment was
that the statute requires demonstration of intent.  Reportedly, the
grand jury and the local D.A. weren't certain they could prove intent,
and hence wanted to offer Morris a plea bargain to a misdemeanor.
The Justice Department wanted none of that, ostensibly to demonstrate
that they're serious about hacking.
