Legal document means nothing? gee, I've heard that one before... right before I froze my ex-employers bank account for failure to pay me owed wages. if you really want to make your displeasure hit home with this company, then I would suggest that you invest in a half hour talking with a lawyer, and finding out the procedures for suing somebody out of state. As the amount is so little, you could do this in small claims court, which here in New York costs $5, and you get that from the defandant if you win the case. Before filing, you might have to send them back the modem you now have, GET A RECIEPT, or some document that they refused shipment. Do this because accepting the present modem may be ground for them saying that you accepted the subsitution. As for the invoice, it most certinaly is a legal document. My ex-boss claimed I had submitted false hours, so wasnt paying me, but the judge accepted my hand written notes as proof of my hours. (He did ask for a break-down of them in some cases..) His acceptance made my notes a legal document! how can an invoice not be??!!?? Once through with small claims, the defendant has one week (In New York) to settle with the Plaintiff, of the plaintiff can take further action, which could include freezing the defendants bank account for twice the awarded amount, plus the bank fees.. :-) In the case of a large company, freezing 4-500 dollars is not going to harm them, but it does put a black mark on thier record, which I'm sure they would rather avoid.
