Ah yes...but are we going to determine the results of this vote by the old rules or by the new rules? Seems to me, the only fair thing to do is to go by the new rules if and only if the vote passes. So, let's say we get 60% YES votes. By the old rules, it passes, so we have to use the new rules. By the new rules, it fails, so we have to use the old rules. Hmmmm...
