     The FCC has jurisdiction over radio waves, defined as "Electromagnetic
waves of frequencies arbitrarily lower than 3,000 GHz, propagated in 
space without artificial guide."  Source: 47 CFR Ch.1, section 2.1.

     FCC jurisdiction thus ends somewhere in the long infrared.  Optical
communication systems do not require FCC licencing.  Safety of optical
emitters is regulated by the Department of Health and Human Services.
