The check boxes in the CDEV still indicate that they're turned off. If the sound code can't read the resource in Finder Sounds Config for any reason, it uses its default setting to play the sounds. It tries to read those settings whenever it is initialized (either during a Finder launch or when the Finder is switched into the foreground). I imagine that the code wasn't able to read the settings after coming into the foreground when you observed the flakiness. I'm currently working on version 1.1 to add a couple of features and fix a couple of shortcomings.
