Game designers who sell their games to publishers should retain rights to the games, such that the full rights revert to the designer if 1) the game company folds, or 2) the game company ceases publishing the game for two years or more. By "should" I mean "should make it a part of the contract". This would protect game designers against companies which can't, or won't, promote the games.
