I can't say anything about the legality, but I'd be careful about spending anything for most games without docs. I know that one of the first things Populous does is show you a coat of arms and ask you what world it belongs to. Of course the docs contain the answers, so if you don't have the docs, you can't even see what its like. Most games are using something similar nowdays. By the way, Populous is very good, just keep an eye on the clock (the real world one, that is), the night i bought the game, i went to 3:30 the next morning withour even noticing.
