Riker later samples Klingon food in preparation for his new assignment. X! Just before he leaves, X! Worf gives him an emergency transponder to ensure his safe return. X! X! On the bridge, Mendon notices a strange form of bacteria on the Pagh, X! but says nothing. X! Riker is wished well and beamed over. X! X! One of the first things he does is answer a challenge to his authority as first X! officer from his second officer, Lt. Klag. X! Meanwhile, Enterprise sensors detect the same substance on its hull. X! When Mendon mentions that he saw it earlier, he X! is chastised for not reporting it then (though Benzite procedure required that X! he not mention the problem until he had a working solution). X! He is put to work, X! with Data, to analyze the bacteria and find out everything he can about them. X! X! Riker, in the mess hall of the Pagh, deals with such novelties as live serpent X! worms (``Gagh is always best when served live,'' says one Klingon), and two X! Klingon women expressing curiosity about how he would endure ``them''. X! Meanwhile, Mendon and Data find out that the Pagh contains more of the compounds X! the bacteria feed on, and thus are more vulnerable, and the Enterprise begins X! searching for the Pagh. X! X! Kargon, however, has already found the damage, and is convinced this is X! Federation treachery. X! He begins planning to attack the Enterprise, and doubles X! his efforts when they discover the Enterprise is on an intercept course. X! When he orders Riker to give him the secrets of the Enterprise, however, X! Riker refuses, saying it is possible for him to follow his oath to the X! Pagh without breaking his oath to Starfleet. X! When Captain Picard is unable to have X! the orders changed, Data's only option is to resign from Starfleet. X! His decision to resign, however, is challenged by Maddox on the basis that Data X! is not a person with rights, but property of the Federation. X! X! The J.A.G. (Judge Advocate General) officer of the Starbase, Phillipa X! Louvois, an old acquaintance of Picard, rules that Maddox's contention is X! supported by a twenty-first century precedent. X! Picard announces that he will challenge that ruling at a hearing. X! Insufficently staffed, Phillipa explains that as senior officer, X! Picard would have to defend Data, while the next most senior officer, X! Riker, would have to prosecute. X! A stickler for the law, X! Phillipa warns that if Riker does not give his best effort, X! she will summarily rule in favor of Maddox. X! X! In his prosecution, Riker contends that Data is simply a machine\-the creation X! of man\-and dramatically emphasizes his point by approaching Data from behind X! and switching him off, leaving him lifeless in his seat. X! Certain of his defeat, X! Picard has a discussion with Guinan and she suggests that the X! Federation's desire to create and own a race of disposable androids X! is the recreation of slavery. X! X! Making an impassioned plea for Data's freedom, Picard declares that in a X! sense, all beings are created but that does not necessarily make them the X! property of their creator. X! Captain Phillipa Louvois, X! who once prosecuted him in the Stargazer court-martial, X! but is now working for the JAG (Judge Advocate General) office in this sector. X! Also on hand is Commander Bruce Maddox, who once on board the X! Enterprise, announces his intention to dismantle Data. X! X! Maddox is an expert in cybernetics, and has worked for years to recreate the X! work of Dr. Soongh, and he believes examining Data will give him the boost he X! needs to create many more androids like Data. X! However, when Picard, wary of Maddox's vagueness, X! declines the offer, Maddox produces orders transferring Data to his command. X! X! After talking to Data, Picard goes to Phillipa to find a way to block the X! transfer. X! Unfortunately, the only option is for Data to resign from Starfleet. X! This he does, immediately, but is interrupted while packing by Dr. Maddox, X! who claims Data cannot resign. X! Data says that he must, to protect Soongh's dream. X! X! Maddox takes his complaint to Phillipa, and claims that since Data is property, X! he cannot resign. X! As she starts looking into this possibility, Data is thrown X! a going-away party and wished well in whatever he chooses to do. X! However, Phillipa then tells Picard and Riker that, X! according to the Acts of Cumberland, Data \f3is\f1 the property of Starfleet, X! and thus cannot resign, or even refuse to cooperate with Maddox. X! Further, if a hearing is held to challenge this X! ruling, since Phillipa has no staff, serving officers must serve as counsel, X! with Picard defending and Riker prosecuting. X! X! Riker does some research and presents a devastating case for the prosecution, X! turning Data off while talking about cutting Pinocchio's strings. X! Picard, taken aback, asks for a recess, and talks to Guinan. X! Guinan subtly gets Picard to realize that if Data, and his eventual successors, X! are held to be ``disposable people'', X! that's no better than slavery all over again. X! Picard, renewed, presents his defense. X! X! He asks Data why he values such things as his medals, a gift from Picard, and X! especially a holographic image of Tasha (surprising Phillipa with Data's X! statement that they were ``intimate''). X! He calls Maddox as a hostile witness, X! and demands from him the requirements for sentience. X! Finally, Picard points out X! that the possibility of thousands of Datas is becoming a race, and claims that X! ``Starfleet was founded to seek out new life\-well \f3there it sits!!\f1'' X!
