I think it might be the same problem I have with Stuart when the window comes up and nothing happens in it, that the /dev/ttyp# is owned by someone else. I don't know how emacs "gets" a tty, but perhaps it is changing ownership of the tty _after_ attempting to get it, then allowing your second try to be successful. Only an opinion.
