Anyone know fer sure? If the TOS ROM code is taken directly from the Atari's TOS ROM then it is quite illegal. It does not matter if it is incorporated into the program it is still infringement on Atari's ROM copyright. If, however, the programmers who programmed the emulator also programmed the ROM code themselves, like A64's ROM, then it is legal. There is probably no way to know for sure exactly what the programmers used, in the way of ROM, except to contact the original author.
