There was an 'interlocutory' (which I understand means nonbinding) decision last February. Judge Phelps, on the last page of the decision, basically said 'Intel, if you think I cant award money damages to AMD, NOW would be a real good time to file briefs with your argument to that effect, because I dont want to go through all this hassle to have it claimed that I have exceeded my authority as arbitrator when I award damages.' Then, in the recent decision, Judge Phelps said he considered the previous 'interlocutory' decision to be considered as a part of the final decision.
