Very true, but the issue remains that they put the ROM SIMM socket there in the first place, probably because they knew that it would be needed. Face it, if they decide it's important they'll figure out a way to protect their intellectual property rights, and I don't think it'll take more than a few days for someone to think up a good idea. It might even be as simple as requiring a serial number from the dealer for every upgrade kit sold. If the warranty registration card was sent in, they can cross-check the number. If a set goes astray, the dealer gets support revoked. No, seriously.
