It's covered by the MIT copyright. The Apollo FAQ file, available by ftp from dabo.citi.umich.edu, should point to the source (I got mine from ucbarpa.berkeley.edu). There is also a binary only version of tn3270 on dabo for those who don't want to go to the trouble of compiling -- not that it's hard, but it does depend on imake and having the x11r4 distribution installed, which you might not want.
