"Legality" is tricky here. You can generally use any name you like, any time you like, provided that it is not for fraudulent purposes. If you ALWAYS used your maiden name, about the only way you could get in trouble would be using it in such a way as to hide your marriage - for example, if you hid your husband's debts while trying to get a lone that you were both going to sign.
