I am basing it on the documented fact that passive smoking is harmful. (I stand ready to support that statement with quotes and sources which I have previously posted to the net. If you claim that passive smoking is not harmful, please cite your sources, preferably along with some convincing quotes.) The idea that the legal system should be based on rights, not restrictions, sounds wonderful; but what does that mean? The U.S. government has long recognized that the right to the freedom of speech does not include the right to yell "Fire!" in a crowded theater.
