I have a more drastic proposal for the entire legal system, though not as drastic as taking all the lawyers out to the parking lot one morning at dawn and shooting them! It goes like this: (this is the Linda Koscher solution) Hire a lawyer (better yet a FIRM of lawyers to get expertise in a wide variety of legal areas) to manage the legal aspects of your life. Make this compulsory, like automobile insurance, for everyone who runs the risk of ending up in court for any reason (which is almost everyone). Pay them a small monthly wage. When trouble strikes, it is their fault. Stop paying them, until the legal hassles are handled. clearly, if you can be sued, or if you feel obligated to sue someone, somebody isnt doing his legal job properly. this scheme's advantages are obvious -- more people will try to settle out of court, which is in my opinion a good thing, and there is great impetus to have short court battles which commence quickly after the intent to 'go to court' has been voiced. comments?
