However, in some cities it is illegal, such as San Luis Obispo, where it is also illegal to sit on the sidewalk or on the side of the road (this law was made so that police could more easily arrest hitchhikers). The State law, according to the "West's" guide (no relation), states that if a jaywalker got hit by a car, since the automobile had the right-of-way, the automobile driver could sue the jaywalker for any damage, but that the jaywalker couldn't sue the driver. It does not state that all jaywalking is illegal, else how would one cross the street when there are several miles between blocks! Interesting trivia: Argentina's motor vehicle code was taken almost word for word from California's (or so I'm told).
