I saw that on TV also.  The commentator commented that though surcharges for
credit card use are illegal, cash discounts are OK.  Therefore:

Regular price of item: $1.00
Cash Price: $1.00
Credit Card Price: $1.05
This is illegal.

Regular price of item: $1.05
Cash Price: $1.00
Credit Card Price: $1.05
This is allowed.
