Spock is not in the gym scene at all. Charlie makes the man "go away" and does likewise to the phasers but he does nothing at all to Kirk (or Spock, naturally) in that scene. Later, in Yeoman Rand's room, Charlie "throws" Kirk and Spock against the wall. When he releases Kirk, Spock tells the captain that his legs are broken. Charlie then releases Spocks legs be- cause he doesn't want to get Kirk mad. It's interesting to note that Spock's legs were never actually broken. Charlie had only locked them in place so that Spock could not move.
