I think you will find that bartenders or their establishments ARE held
liable in the same jurisdictions that hosts are.

0^0         How do you deal with the following scenario?

0^0           Guest A has been drinking quite a bit at your party, but seems
0^0           alert, sober, and quite in control. Guest A assures you they're
0^0           fine, have a high tolerance for booze, that there's no problem,
0^0           and they have to leave for an important appointment.

0^0           So off they go. On their way, they get in an accident (which may
0^0           or may not be their fault). They fail a blood alcohol test.

0^0           Bingo. You lose.

The easiest way I've found to keep this from being a problem at my parties
is to simply limit alcohol to Wine and Beer and not support other
substances. It is MUCH harder to get too drunk on these lower alcohol
drinks, especially when everyone is having such a good time they forget to
drink anyway. Having munchies helps because filling the stomach slows the
ingestion of alcohol over a longer period of time and helps reduce the
impact of a given amount (I've found chuqui's world famous pasta to be a
great help in staying sober, but them I'm biased...)
