Lines: 58 **** *Elderly man kills one attacker, wounds another* Los Angeles (AP) - A 73-year-old visitor from the High Sierra, awakened in his pickup truck by two men punching and kicking him, shot one to death and wonded the other with a .22 caliber pistol, police said. The dead man was found by the truck's bumper, which has a bumper sticker that reads: "This car insured by Smith and Wesson," a firearms manufacturer, police detective William Eisentraut said. The elderly man, a retired construction worker from Bishop, was not identified by police, who said they feared for his safety if his name got out. He was visiting friends in Los Angles and sleeping in his truck parked near their home, a few miles west of downtown, Eisentraut said. His pickup had a camper shell that could be locked only from the outside, Eisentraut said. At 1:45 a.m. the man "was awakened by two ment who were climbing on top of him, punching his face and choking him," Eisentraut said. "He managed to get his handgun out and during the struggle fired several shots," he daid. Steven Aldoulphus Carter, 27, of Los Angles was pronounced dead at the scene, the detective said. He had been shot in the chest. Charles William Carter, 27, his brother, addmitted himself to County-USC Medical Center, Eisentraut said. Charles Carter was booked for investigation of murder -- the death of his Steven Carter -- and was in stable condition in the hospital's jail ward with a bullet lodged in his jaw, he said. Under California law, people may be charged with murder if anyone dies during the commission of theri felony, even if the alleged murder did not physically kill the person. The retired construction worker was questioned and released, Eisentraut said. He did not have a permit for the gun, he said, but it was unlikely that charges would be filed.
