I haven't heard this point discussed explicitly but the sense I get from what I have been able to find out is that he hadn't. So here we are being treated to the spectacle of an agent of the United States Government saying: "If you break the law, we'll put you in prison. On the other hand, if you don't break it, we'll kill you." Kind of makes you proud to be an American, doesn't it.
