Anybody who goes out and does somthing as stupid as trashing a town deserves to be knocked off. The player/character is dumb enough as it is. I'm not saying that the PC has to be killed, but he should be punished hard enough to make sure that he doesn't do it again. Also, you don't have to use a 40th level wizard, a milita of fifty or sixty men would probably do as well, and be far more realistic.
