You are simplifying things a little too much for my taste.  As far as I know,
no matter how archaic the US judicial system is, everyone gets a chance to
state their case, including the prosecution.

I'd still rather be humiliated and alive than gloriously dead.  Furthermore
there are other ways of retaliating against rape that do not necessarily
involve the Judicial system.
