I'm not to sure about that, but wouldn't the injuries the person wearing the seatbelt be identifibly different from a person who was not wearing a seatbelt? In a high speed collision I would think a person wearing a seatbelt would have bruises across the waist and chest where the straps were. Also a person wearing a seatbelt would be unlikely to have suffered head injuries. Overall the idea of not paying off accident victim who weren't wearing seatbelts doesn't strike me as very practical. It would be nice if people who wore their seatbelts regularly could get lower rates, but I don't have a glimmer about how the insurance company could verify it.
