In Newsweek a couple of weeks ago there was a story about a lawyer who got sued not because he didn't win his case (he did), but because the judge decided that he didn't sue everybody he could! This was for a medical malpractice, and nobody was bringing suit against the lawyer, the judge just decided that more people should be sued. Now what do you think is going to happen in the courts now that lawyers know that they can be sued themselves if they don't file enough lawsuits?
