In fact, according to the latest AMA magazine, they are now legal throughout the country. The reason for these "flashers" is to be seen better by other vehicles. As you have found out, the bike was MUCH more noticeable with the headlight flashing (I wish I had one on when the driver of the car that pulled out in front of me looked at me before turning, and obviously didn't see me). They, however, are NOT legal after dark. (Perhaps the driver of the bike needed to adjust his headlight a bit better if, as you say, other drivers were re-adjusting their mirrors to compensate.)
