Nonsense. It's no more illegal than Toyota building cars without getting permission from Ford. Intel has no property rights in what an 8088 looks like to the outside world, unless there are patents involved (which I doubt). Nor do they have any property rights in the name "8088". The legal squabble is over whether copying the *insides* is legitimate.
