That is why no military appropriations bill can have effect for more than two years. When needed for war, the Army of the United States was formed (Article I, Section 8) by Congress calling up the state militias (see wording of the 2nd Amendment) and the necessary appropriations passed. The President was to be Commander-in-Chief only when the AUS had been formed; otherwise, he had no army. This was the original check and balance of power built into the Constitution. -- Warren N.
