It descended from an old version of a public-domain MicroEmacs, I think it was called 0.1. Andy Finkel here at Commodore made extensive modifications to the program to the point where it is certainly a different program. If a program's in the public domain, you're free to use parts or all of it in your own program, whether commercial or another freebie.
