For some reason (I wonder why?), this reminds me of the case where a woman sued her company because, while they would provide leave for prostate surgery, they would not provide comparable maternity leave. The judge ruled that the company was not discriminating on the basis of gender because "if a man got pregnant, he wouldn't get leave either." The woman suing felt much better.
