Technical point: if someone attempts to convince someone to kill or maim others (as opposed to saying he'd like to kill someone), he is subject to a charge of "procuring the commission of a crime". It is a judgment call by a real Judge as to whether he was *committing* a crime... On a different sub-subject, if that message passed through the ARPAnet it can probably be tracked: SMTP had that capability designed in to its logging facilities (well, usually).
