Summary: Is this a sham?

I purchased 2 ZIP Chips at AppleFest and was told to wait 4-6 weeks due to
the backordering. Now, I got a letter from the co. saying it will be another
4-6 weeks due to the great demand. I believed it until someone told me today
that ZIP Technologies is currently being sued for the rights to the chip. Could
their "can't-ship-now-due-to-backordering" excuse be a cover-up? I'm becomg
very skeptical about the whole situation: the product just seems too good to
be true. Could the company be doing this as a last-ditch attempt to scrounge
up some money before all if it is "sued away"? I'd really appreciate any
info on this topic, as I have over $200 riding on this (I bought 2 of them).
