I don't know where to refer you to for a good published source on this,
but the makers of CrossTalk (a PC communications package) sued SoftKlone
for Mirror, a CrossTalk clone. The court ruled that SoftKlone had to
change the user interface to make it different from CrossTalk. However,
SoftClone did not have to design a new scripting language--they were
allowed to continue using what CrossTalk uses. Both companies claimed
victory as a result...
