For new stuff, maybe, but what if you'd like your batch files to work under DOS 3.1, 3.2 and 3.3 as well as Dos 4.0? There are still those who are using the older versions, and there is so little incentive to move from DOS 3.1 I suspect they'll be around for a long time.
